WHAT A DEVELOPER NOC IS
A No Objection Certificate, or NOC, is a document issued by the developer confirming it has no objection to a specific action on your property, usually a sale or a change to the unit.
For a resale, it is the developer’s written confirmation that the property is clear to transfer: all service charges are paid, there are no outstanding violations, and the developer does not stand in the way of the sale. It is a clearance letter, not a formality. For anyone selling in an Emaar community such as Dubai Hills Estate, the NOC comes from Emaar, and no sale completes without it.
WHY IT MATTERS
Without a developer NOC, the Dubai Land Department will not transfer the property. The NOC sits between you and the trustee office, and no transfer, ready or off-plan, completes without it. This is why the NOC step is where problems surface. If service charges are unpaid, or if an earlier owner made changes Emaar never approved, it comes out here, and the sale stalls until it is fixed. The NOC also protects the buyer, because it confirms they are taking on a clean unit with no hidden liabilities attached to the title.
THE MAIN TYPES OF NOC
The word NOC covers several different approvals, and people often confuse them. Three matter most.
SALE OR TRANSFER NOC
This is the one you need to sell. It confirms the unit is clear to transfer to a new owner and is the document the DLD trustee requires on the transfer date. Everything below in the Emaar section refers to this NOC.
MODIFICATION NOC
A modification NOC covers changes to an existing property that alter its appearance, layout or systems without adding new built-up area.
That includes moving internal walls, converting a garage into a room, enclosing a terrace within the existing footprint, changing external cladding or paint, altering boundary walls, or relocating external air-conditioning units.
Emaar issues it to confirm the work complies with community design guidelines, and for anything structural you will also need a Dubai Municipality building permit on top of the developer NOC.
EXTENSION NOC
An extension NOC is different, and more expensive, because an extension means adding new enclosed built-up area, not just changing what exists.
In Emaar communities, including Dubai Hills Estate, adding area triggers a gross floor area fee charged per square foot of new space, which is why the same extension can cost far more inside a Dubai Hills villa than on an independent mainland plot.
An extension almost always needs the full chain: the Emaar NOC, then a Dubai Municipality building permit, and for larger additions a soil report and a Civil Defence NOC as well.
Beyond these three, Emaar and banks also issue NOCs for mortgage settlement and for certain leasing and visa situations, but for a seller the transfer NOC is the one that gates the deal.
HOW TO GET AN EMAAR NOC FOR A READY RESALE
Emaar has moved this process online, and in most cases it is now fast. The sequence is straightforward once the groundwork is done.
- Clear the ground first. Make sure all service charges are fully paid and there are no outstanding community violations on the unit. Any unpaid balance or unapproved modification will hold the NOC.
- Sign the sale agreement. The buyer and seller sign the Memorandum of Understanding, the standard Form F, and the buyer pays the deposit, usually around ten percent held by the agent or a registration trustee.
- Raise the request with Emaar. The seller logs in to the Emaar One app or the Emaar E-Service portal at eservice.emaar.com, which is synced to the same account, opens Raise Service Request, and under NOCs selects NOC for Transfer, entering the buyer’s name, email, the sale price and the agency name. Emaar then emails the buyer a secure link to upload their Emirates ID and passport, plus the bank offer letter and mortgage documents if the purchase is financed.
- Emaar verifies and clears. Emaar checks that service charges are settled and there are no violations, then releases the NOC. If a balance is due, they notify you of the amount before issuing.
- Collect the NOC and transfer. It is issued digitally in most cases. You then take it to the DLD trustee office for the ownership transfer.
OFF-PLAN RESALE: HOW THE PROCESS WORKS
For an off-plan resale, where the unit is still under construction and registered on Oqood rather than a title deed, Emaar treats the sale as a primary market transfer. This is common across Dubai Hills Estate’s newer launches and communities like The Oasis. The NOC runs through the same channel as a ready unit, with a few extra conditions.
First, confirm eligibility. Emaar will only allow the resale once the seller has paid the minimum share of the price set in the sale and purchase agreement, commonly in the region of thirty to forty percent, and the payment plan must be current with nothing overdue.
Next, the seller raises the transfer request in the Emaar One app or the Emaar E-Service portal, the same Raise Service Request used for ready units, selecting NOC for Transfer and entering the buyer’s name, email, the sale price and the agency. Emaar then emails the buyer a secure link to upload their Emirates ID and passport, and, if the buyer is using a mortgage, the bank offer letter and supporting documents.
Emaar verifies the account is paid up to the required level and issues the NOC. The buyer takes over the remaining payment plan, and a fresh sale and purchase agreement is issued in the buyer’s name. The transfer itself is completed at the Dubai Land Department against the Oqood rather than a title deed, and a new Oqood is registered to the buyer. As with any resale, the DLD will not move the Oqood without the developer NOC.
THE STATEMENT OF ACCOUNT
Before you apply, pull a current statement of account from Emaar. For an off-plan unit this is the document that proves you are eligible to resell: it shows every installment paid to date, the percentage of the price you have covered, and any balance outstanding.
Emaar checks this against the minimum resale threshold in your sale and purchase agreement and against whether any payment is overdue.
For a ready unit, the equivalent check is the service-charge account, which must show a zero balance. In both cases, request the statement early.
It is the single document most likely to reveal a problem you did not know about, such as a missed installment or an unpaid service-charge quarter, and it is far better to find that before you have a buyer waiting.
DOCUMENTS YOU WILL NEED
For a ready, secondary resale, the standard set is:
- Title deed issued by the Dubai Land Department
- Passport and Emirates ID copies of both seller and buyer
- The signed sale agreement, being the Memorandum of Understanding or Form F
- The buyer’s proof of funds, or if the purchase is mortgaged, the bank’s final offer letter and mortgage documents
- A mortgage clearance or liability letter from the seller’s bank if the unit was financed, confirming the loan is settled
- Confirmation that service charges are paid in full
- A notarised power of attorney if either party cannot apply in person
For an off-plan, primary resale, replace the title deed with:
- The Oqood or pre-registration document
- The sale and purchase agreement with Emaar
- A current statement of account from Emaar showing installments paid and the percentage completed
- Proof that the minimum resale threshold set in the sale and purchase agreement has been met
If either the buyer or seller is a company, Emaar will also ask for the trade licence, the certificate of incorporation, a fresh certificate of incumbency, and a board resolution. For an offshore company these must be notarised and attested through the UAE embassy in the country of issue and the Ministry of Foreign Affairs.
FEES AND TIMELINE
Emaar’s transfer NOC fee is typically around AED 1,000, with a faster express option at roughly AED 2,000 for twenty-four-hour processing, and higher-value units in some communities can run more.
Across developers generally the range sits between about AED 500 and AED 5,000. The fee is customarily paid by the seller, though it is negotiable.
On timing, most major developers moved to digital, near-instant NOCs through 2026, and a clean Emaar file often clears within twenty-four to forty-eight hours, with anything more complex taking up to around five working days.
THE MISTAKE THAT KILLS DEALS
The most common reason a resale collapses at the NOC stage is an unapproved change to the property.
In villa communities like Dubai Hills Estate this is especially common: if a previous owner enclosed a terrace, converted a garage, added a pool or built an extension without Emaar’s approval, that violation surfaces when Emaar reviews the file, and Emaar can withhold the NOC until it is regularised. Regularisation means a retrospective NOC, a review, penalty payments and a completion inspection, which can take weeks.
If you are selling, check for any unapproved works and clear them before you list, not after you have a buyer waiting. If you are buying, treat a clean NOC as confirmation that what you are buying is what the developer actually approved.
BEFORE YOU LIST
The practical order is simple. Pull your statement of account, settle service charges or any overdue installment, confirm there are no violations, and if the unit was ever altered, make sure those changes were approved.
Doing this before the property goes to market means the NOC becomes a two-day formality rather than the point where your sale falls apart.
