Dubai Hills Estate has one of the highest shares of tenanted resale stock in Emaar‘s portfolio, simply because so many units were bought as investments. That means a large chunk of sellers there aren’t handing over an empty apartment — they’re handing over one with a person living in it, a lease running, and a notice period that has to be handled correctly before a sale can close cleanly. Get the notice wrong, and you’re not looking at a delayed handover; you’re looking at a Rental Dispute Centre case and possibly a compensation order. Here’s what actually applies, and where sellers and agents tend to trip up.

FIRST: A SALE DOES NOT EVICT THE TENANT BY ITSELF

This is the part people get backwards most often. Selling your property does not end the existing lease, and it does not obligate the tenant to move out on completion day. Under Dubai’s tenancy law, ownership transfer doesn’t affect the tenant’s right to keep occupying the property under the existing contract — the new owner simply inherits the lease, the rent, and the terms as they stand. So if you sell with a tenant in place and don’t do anything else, the buyer becomes the landlord, and the tenant stays until the lease naturally expires or is properly terminated later.

If your buyer wants vacant possession, ending the tenancy is a separate legal step from the sale itself, and it has its own timeline that rarely fits around a typical 30–60 day transaction.

THE 12-MONTH NOTICE, IF YOU WANT THE TENANT OUT FOR THE SALE

Wanting to sell your property is a valid ground for ending a tenancy under Dubai law (the seller’s intent to sell the property), but it comes with strict conditions: the landlord has to give at least 12 months’ notice before the eviction date, and that notice has to be served through a notary public or registered mail — not WhatsApp, not a text, not a verbal heads-up, and not a regular email, none of which hold up if the tenant disputes it later. In practice, this notice period is usually pegged to the lease’s expiry so the tenant isn’t asked to leave mid-contract; if the current lease still has, say, four months left when you decide to sell, the 12-month clock effectively extends the tenant’s stay well past that renewal date, not the other way around.

This is the single biggest planning mistake sellers make in Dubai Hills: deciding to sell, listing the unit for vacant possession, and only then realizing the earliest a tenant can legally be asked to leave is a year out. If you want vacant possession and the lease renewal is coming up soon, the notice needs to go out via notary or registered mail well before that renewal date — not after you’ve already found a buyer.

SELLING TENANTED VS. SELLING VACANT

You’ve got two realistic paths, and which one makes sense depends on your buyer pool and your timeline.

Selling with the tenant in place is the faster route and often the more attractive one to investor buyers, who actively want a unit that’s already generating rent rather than sitting empty during a search for a new tenant. The lease, the rent amount, the security deposit, and any post-dated cheques all transfer to the buyer as part of the handover — this needs to be documented cleanly in the sale agreement, and the buyer needs to see the Ejari and tenancy contract before they commit, not discover the tenancy after signing.

Selling vacant means either waiting out the 12-month notice properly, or negotiating directly with the tenant for an earlier, voluntary exit — commonly called a “cash-for-keys” arrangement, where the seller offers the tenant moving costs, a rent-free final month or two, or a lump sum in exchange for leaving ahead of the legal notice period. This is entirely a private negotiation, not a legal shortcut, and it only works if the tenant actually agrees — you can’t threaten your way into a faster exit and expect it to hold up if challenged.

PRACTICAL HANDLING WHILE THE UNIT IS ON THE MARKET

While the tenant is still living there and you’re actively selling, a few things matter for keeping the process friction-free. Agents and buyers generally need 24–48 hours’ notice before any viewing — you can’t have people showing up unannounced, and a tenant who feels their quiet enjoyment of the home is being ignored is far more likely to become uncooperative or contest things later.

Make sure Ejari is current before you list — a lapsed or mismatched Ejari registration is one of the most common reasons a viewing permit or later paperwork gets stuck, and it also matters because the Rental Dispute Centre can refuse to hear a case tied to a contract that was never properly registered.

And for Emaar-managed communities specifically, agents may need a No Objection Certificate from Emaar Community Management before conducting a viewing in the building — this is separate from anything to do with the tenant and is worth confirming with Dubai Hills’ community management office ahead of time so it doesn’t hold up a viewing at the last minute.

PRACTICAL HANDLING WHILE THE UNIT IS ON THE MARKET

A handful of patterns account for most of the friction sellers and tenants run into around Dubai Hills sales.

The “I’m selling” excuse that isn’t real. The most common complaint tenants raise is a landlord citing intent to sell to get a compliant-looking notice out, evicting the tenant, and then quietly re-listing the unit for rent instead of actually selling it. Courts have taken this seriously — there’s a well-known Dubai Rental Dispute Centre ruling that ordered a landlord to pay a tenant roughly AED 700,000 in compensation over an eviction handled in bad faith, and cases like it are exactly why “sale” needs to be a genuine, followable-through intention, not a convenient label to get someone out faster. If a unit gets re-rented shortly after an eviction that was justified as a sale, that’s exactly the pattern a tenant’s lawyer will go looking for.

Notice served the wrong way. Notice by email, WhatsApp, a printed letter handed over in person, or through the agent verbally is not valid under the law regardless of how clearly it was communicated — it has to go through a notary public or registered mail (commonly via the Tableegh court notification service) to count. Sellers who serve notice informally and then try to enforce an eviction on that basis routinely lose at the Rental Dispute Centre.

Notice period miscounted. Because the 12 months typically has to run from the end of the existing lease term rather than from an arbitrary date the seller picks, a notice sent “12 months before I want to sell” can still be invalid if it lands mid-contract rather than at renewal.

Security deposit and post-dated cheque handovers. When ownership changes hands with a tenant in place, the deposit and any post-dated cheques need to be formally transferred to the buyer as the incoming landlord — disputes come up when this handover isn’t documented and the tenant later can’t get clarity on who’s actually holding their deposit, or the new owner tries to hold the outgoing landlord’s obligations against the tenant.

Undisclosed tenancy to the buyer. Occasionally a seller undersells or omits the tenancy status to a buyer who specifically wanted vacant possession, leaving the buyer to discover only after transfer that they now have a sitting tenant with 8–10 months left on notice they didn’t budget for. This is a contractual dispute between buyer and seller more than a landlord-tenant one, but it’s common enough in Dubai Hills to flag: put the tenancy status and lease expiry in writing, in the sale agreement, before signing.

WHERE DISPUTES ACTUALLY GET RESOLVED

If the notice, the eviction, or the deposit becomes contentious, it goes to Dubai’s Rental Dispute Centre (RDC) rather than the regular courts. Claims under a set threshold get a fast-track process aimed at resolving things within about 15 working days, though contested cases with disputed facts (like a claimed sale that never happened) tend to take longer. Either side can file — a tenant contesting an invalid notice, or a landlord seeking to enforce a lawfully served one.

THE BOTTOM LINE

If you’re selling a tenanted unit in Dubai Hills Estate, the sale itself and the tenancy are two separate legal tracks that only intersect if you choose to make them intersect. Selling with the tenant in place is usually faster and can be a selling point to investor buyers; pushing for vacant possession means either the full 12-month notarized notice process started well ahead of time, or a negotiated, voluntary early exit the tenant actually agrees to. Whichever route you take, get the tenancy status in writing to your buyer, get the notice served through the correct legal channel if you’re going that route, and don’t cite a sale you don’t intend to complete — it’s the single fastest way to end up in front of the Rental Dispute Centre.
